1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders placed through the online shop Aurelia Astor at https://aureliaastor.com.
The online shop is operated by Barbara Köhler under the artist name Aurelia Astor.
The shop is intended for both consumers and businesses.
Consumers are individuals who enter into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activities.
Businesses are individuals or companies acting in the course of their commercial or self-employed professional activities when entering into a legal transaction.
Mandatory provisions of Austrian consumer protection law apply to consumers. These rights are not restricted by these GTC.

3. Products and Offers
The online shop offers, in particular, handmade linocuts, limited-edition prints, artworks and, where applicable, individually commissioned artworks.
Product images are provided to illustrate the respective artworks. Due to differences in screen settings, minor variations in colour reproduction may occur.
Hand-printed artworks are original prints made by hand. Variations in the application and intensity of colour, texture, print appearance and other minor differences are characteristic of the handcrafted production process and do not constitute a defect, provided that they do not materially affect the agreed characteristics of the artwork.
4. Ordering and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer to conclude a purchase contract.
By submitting an order, the customer makes a binding offer to conclude a purchase contract for the selected products.
After receiving an order, the customer will receive an automatic confirmation by email. This confirmation merely acknowledges receipt of the order and does not constitute acceptance of the offer unless acceptance is expressly stated in the confirmation.
The purchase contract is concluded when the provider expressly accepts the order or dispatches the goods to the customer.
If an ordered artwork is unavailable, the customer will be informed without undue delay. Any payments already made will be refunded in full.
5. Prices and VAT
All prices in the online shop are stated in euros and include the applicable statutory VAT, unless expressly stated otherwise.
The tax regulations applicable in the respective destination country will be applied in accordance with the applicable legal requirements.
For deliveries to countries outside the European Union, import VAT, customs duties, customs clearance fees, handling fees or other charges imposed by the destination country may apply in addition to the purchase price.
These costs are not covered by the provider and must be paid by the buyer.
The buyer is responsible for obtaining information about the import regulations, duties and taxes applicable in their destination country.
6. Payment Terms
The payment methods available in the online shop are displayed during the checkout process.
Payment is due immediately after the order has been placed, unless otherwise stated for the respective payment method.
7. Shipping and Delivery
Shipping costs are generally already included in the stated purchase price, unless otherwise indicated for the respective product or during the checkout process.
The countries to which we ship and the available shipping methods are displayed in the online shop or during checkout.
Delivery will be made to the shipping address provided by the customer.
The estimated delivery time is stated on the respective product page or during the ordering process.
For international deliveries, customs clearance, import regulations or delays caused by the shipping provider may result in longer delivery times.
For deliveries outside the European Union, the buyer is responsible for all import duties and charges incurred in the destination country, including customs duties, import VAT and any customs clearance or handling fees.
The provider does not cover these costs.
8. Custom-Made Works and Commissions
Individually created artworks or commissioned works may be offered upon request.
Before any custom work begins, the scope, subject, format, price, delivery time and any other individual requirements will be agreed between the provider and the customer.
For goods made according to the customer's specifications or clearly personalised to the customer's requirements, consumers do not have a statutory right of withdrawal where the legal requirements for the relevant exception are met.
The applicable details will be communicated to the customer before the work begins.
9. Retention of Title
The goods remain the property of the provider until payment has been made in full.
10. Statutory Right of Withdrawal for Consumers
Consumers generally have a statutory right to withdraw from distance contracts within 14 days without giving any reason.
The detailed provisions concerning the right of withdrawal, the withdrawal period, the exercise of the right of withdrawal and the consequences of withdrawal are set out in the separate Right of Withdrawal notice.
For goods made according to the customer's specifications, the right of withdrawal may be excluded where the statutory requirements for such an exception are met.
Businesses do not have a statutory right of withdrawal under the Austrian Distance and Outward Transactions Act (FAGG).
11. Consequences of Withdrawal
If a consumer validly withdraws from the contract, all payments made by the consumer, including the cost of standard delivery, will be refunded in accordance with the applicable statutory provisions.
If the consumer has chosen a more expensive delivery method than the least expensive standard delivery offered by the provider, any additional costs will not be refunded.
The refund will generally be made using the same means of payment used for the original transaction, unless otherwise agreed.
The provider may withhold the refund until the goods have been returned or the consumer has provided proof of return, whichever occurs earlier.
The consumer must return the goods without undue delay and no later than 14 days from the day on which they informed the provider of their withdrawal.
The consumer is responsible for the direct costs of returning the goods.
12. Statutory Warranty
The statutory warranty provisions apply.
The provider warrants that the goods are free from defects at the time of delivery and correspond to the agreed or legally required characteristics.
The specific characteristics of hand-printed artworks described in Section 3 of these GTC remain unaffected.
These GTC do not restrict the statutory warranty rights of consumers.
13. Copyright and Usage Rights
All artworks, motifs, photographs, images, texts, graphics and other content of the online shop are protected by copyright.
By purchasing a physical artwork, the buyer acquires ownership of the physical work itself, but not the copyright or other usage rights to the motif.
Reproduction, modification, digitisation, publication or commercial use of the artwork or its motif is not permitted without the prior express consent of the copyright holder.
14. Liability
The provider's liability is governed by the applicable statutory provisions.
The provider is particularly liable for damages resulting from injury to life, body or health, as well as for damages caused intentionally or through gross negligence.
With regard to consumers, liability may only be limited to the extent permitted by law.
15. Data Protection
Information about the processing of personal data can be found in the online shop's separate Privacy Policy.
16. Applicable Law
For contracts with businesses, Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, Austrian law applies to the extent that this does not restrict mandatory provisions of the law of the country in which the consumer has their habitual residence.
17. Place of Jurisdiction
For contracts with businesses, the competent court at the provider's registered place of business shall have jurisdiction, to the extent legally permissible.
For consumers, the statutory rules on jurisdiction apply.
18. Final Provisions
If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
